1. Introduction

Reflective Rhythm ("we," "us," "our") is a web application and mobile application designed to help introspective thinkers explore and expand on their thoughts and ideas. Users can write notes, and our AI assistant actively engages with these notes to provide deeper insights and identify emerging themes. The AI assistant does not use the notes for training purposes but solely to enhance user experience.

2. Eligibility

Eligibility to Use Reflective Rhythm:

  • 2.1 Age:

    Users must not send us any personal information of children under 18 or the applicable age of digital consent. Minors may use our services only with appropriate consent from their parent or guardian.

  • 2.2 Geographic:

    Reflective Rhythm is available to users worldwide, except where prohibited by law.

  • 2.3 Account Criteria:

    Users must provide a valid email address for account creation. By creating an account, users agree to provide accurate and complete information.

3. Account Usage

  • 3.1 Account Creation:

    To create an account with Reflective Rhythm, users must provide a valid email address and create a secure password. Account creation is mandatory to access the AI assistant and personalized note feedback features of the web application.

  • 3.2 Notifications:

    Push Notifications: By using the Reflective Rhythm mobile app, you have the option to enable push notifications to receive writing prompts, summaries, timely updates, and important information directly on your device.

    User Consent: You will only receive push notifications if you enable them on your device. This setting is voluntary, and you may choose to manage your push notification preferences through your device settings at any time.

    Alternative Notifications: Should you choose not to enable push notifications, or if they are disabled, you will receive the same notifications via email. It is your responsibility to provide us with a valid email address and to ensure that our emails are not filtered out by your email service provider.

  • 3.3 User Responsibilities:

    Users agree to use Reflective Rhythm in compliance with all applicable laws and regulations.

    Users must not engage in abusive, threatening, or inappropriate conduct.

    Users are responsible for maintaining the confidentiality of their login information and for any activities that occur under their account.

  • 3.4 Users must not:

    Engage in activities that violate laws or our usage policies.

    Attempt to reverse engineer or extract data from the AI services.

    Utilize the AI service to create competing models.

  • 3.5 Account Termination:

    We reserve the right to terminate or suspend accounts that violate our Terms of Service or engage in prohibited activities.

    Users whose accounts are terminated may contact us through our Contact Us form to inquire about the reasons for termination and any potential recourse.

4. Payments

  • 4.1 Payment Information:

    Subscription Plans: Reflective Rhythm offers both monthly and yearly subscription plans, in addition to a free plan with limited features.

    Payment Methods: Payments are processed securely using industry-standard payment processing services.

  • 4.2 Subscription Management:

    Web Application Subscriptions: If you sign up for a subscription through our web application, you have the flexibility to manage your subscription, including upgrades, downgrades, and cancellations, directly within the Reflective Rhythm app. This convenient feature allows you to adjust your subscription preferences easily on your mobile device.

    iOS Application Subscriptions: If you purchase a subscription through the iOS application, your subscription will be managed through your iTunes account. In this case, any changes to your subscription, such as modifications to the plan or cancellations, must be made via your iTunes account settings. Please refer to the Apple App Store guidelines for detailed instructions on managing subscriptions.

    Users are responsible for understanding the terms and conditions of the platform through which they initiate their subscription, as management options may vary accordingly.

  • 4.3 Refund Policy:

    Refund Conditions: To request a refund, users must contact us through our Contact Us form within 14 days of the initial purchase. Refunds may be granted under the following conditions:

    First Subscription Payment: If you are unsatisfied with the service, you may request a full refund within 14 days of your first subscription payment (either monthly or yearly).

    Billing Errors: If you believe there has been a billing error, contact us within 30 days of the billing date for a resolution.

    Prorated Refunds: For cancellations made after the initial 14-day period but before the end of a subscription period, we may offer prorated refunds for the unused portion of the subscription.

    Non-Refundable Items: Payments made for subscription renewals are non-refundable. We encourage users to review their subscription settings and make any necessary changes before the renewal date.

    Procedure for Refund Requests:

    • Contact Information: Users must request refunds through our Contact Us form, including their account information and the reason for the refund request.

    • Review and Approval: Refund requests will be reviewed, and the user will be notified of the decision within 7 business days.

5. Usage Rules

  • 5.1 Permitted Uses:

    Writing Notes for Reflection: Users are encouraged to use Reflective Rhythm solely for the purpose of writing notes to reflect upon and explore their thoughts and ideas. Engaging with the AI assistant for deeper insights is the primary and intended use of this platform.

  • 5.2 Prohibited Uses:

    AI Content Rules: The AI assistant's responses reflect the training and content rules of the underlying models created by third-party providers. As a result, users may experience limitations, including, but not limited to, restrictions in discussing certain topics or receiving guidance that is influenced by these content rules.

    Illegal Activities: Users must not use Reflective Rhythm to engage in or promote any activity that violates local, state, national, or international laws.

    Abusive Content: Users must refrain from writing notes that contain abusive, threatening, or harassing content.

    Content Misuse: Users must not use Reflective Rhythm to generate content intended for spamming, unauthorized advertising, or other forms of misuse by copying and pasting generated content out of Reflective Rhythm for such purposes.

  • 5.3 Content Moderation:

    While Reflective Rhythm does not pre-moderate user-generated content, we reserve the right to remove any content that violates these Usage Rules or our Terms of Service. Users found in violation may have their access restricted or accounts terminated.

6. Intellectual Property

  • 6.1 Content Ownership:

    User-Generated Content: Users retain ownership of the notes and content they create within Reflective Rhythm. However, this ownership is subject to the terms outlined below.

    AI-Generated Content: As between you and Reflective Rhythm, and in alignment with our service providers’ terms, you own all output generated by the AI assistant in response to user inputs.

  • 6.2 Licenses:

    License to Reflective Rhythm: By using Reflective Rhythm, users grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute their content within the platform to provide and improve our services. This license is necessary for us to, for example, display the notes back to the users, run analyses, and provide relevant AI-generated content.

    Restrictions on Usage: Users may not use Reflective Rhythm’s intellectual property, including trademarks, logos, and copyrighted material, without our express written consent.

7. Content Deletion

  • 7.1 Inactive Account Policy:

    Content Deletion: Content from non-paying users will be deleted after three months of inactivity. Paying users’ content will be retained indefinitely unless they request deletion.

    Policy Agreement: By agreeing to these Terms of Service, users acknowledge and consent to the deletion of their content under these conditions.

8. Disclaimers and Warranties

  • 8.1 Disclaimers of General Nature:

    Reflective Rhythm is provided on an "as-is" and "as-available" basis. We do not guarantee or warrant that the application will be free of errors, security vulnerabilities, or interruptions.

    We disclaim any responsibility for the accuracy, reliability, availability, or timeliness of the service.

  • 8.2 Specific Warranties Disclaimed:

    We expressly disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of usage of trade or course of performance.

  • 8.3 AI-Generated Content Disclaimers:

    Users acknowledge that the AI assistant may generate content that is inaccurate or unreliable. Users are advised to independently verify information obtained through the AI and not rely solely on such content for decisions.

    Reflective Rhythm disclaims liability for any harm or damage that may result from reliance on AI-generated content, including but not limited to physical, psychological, or financial harm.

  • 8.4 Professional Advice Disclaimer:

    Reflective Rhythm's AI and content are not substitutes for professional advice. Users should seek the advice of a qualified professional regarding medical, legal, financial, or other matters.

  • 8.5 Data Usage Responsibility:

    Users are responsible for any data usage charges incurred while using Reflective Rhythm, whether through the web application or the mobile app. Reflective Rhythm is not liable for additional data fees charged by your internet service provider or mobile carrier. Users should verify their data plans with their service providers to avoid unexpected charges.

9. Limitation of Liability

  • 9.1 Scope of Limitations:

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINE LAB LIMITED AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF SUCH DAMAGES.

  • 9.2 Aggregate Liability Limitation:

    OUR TOTAL LIABILITY TO ANY USER SHALL NOT EXCEED THE AMOUNT PAID BY THE USER IN THE 12 MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES TO ANY FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE.

  • 9.3 Specific Exclusions:

    Nothing herein limits or excludes liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Indemnification

Users agree to indemnify, defend, and hold harmless Reflective Rhythm and Line Lab Limited, along with their affiliates, officers, and employees, from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney's fees) arising from user conduct, content, misuse of the service, or breach of these Terms of Service.

11. Dispute Resolution

  • 11.1 Governing Law:

    These Terms of Service will be governed by and construed in accordance with the laws of the State of Colorado, USA, without regard to its conflict of law principles. By using Reflective Rhythm, you agree that any disputes arising from or related to these Terms of Service will be resolved under the laws of Colorado.

  • 11.2 Arbitration Agreement:

    Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, will be settled by binding arbitration administered in accordance with commercial arbitration rules.

    Location: The place of arbitration will be Denver, Colorado, USA.

    Exceptions: Notwithstanding the foregoing, either party may seek injunctive relief or other equitable remedies from a court of competent jurisdiction.

    Class Action Waiver: Users agree to arbitrate solely on an individual basis, and this agreement does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding.

    Finality and Enforcement: The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

12. Terms Update and Contact Information

  • 12.1 Terms Update:

    Notification of Changes: We may update these Terms of Service from time to time. Any changes will be communicated to users in-app upon login. Users are encouraged to review the Terms of Service periodically to stay informed of any updates.

    Acceptance of Updates: Your continued use of Reflective Rhythm after changes to the Terms of Service have been posted will constitute your acceptance of those changes. If you do not agree to the updated terms, you should discontinue using Reflective Rhythm.
